Can a guest only delete subpages but not top-level pages?

I need to have different permissions for different guests in the same group due to enterprise hierarchy. In this case some of the guests have be able to delete top-level pages and subpages, and other guests can only delete subpages. Is it possible to have this permission scheme?

I don't think so.

In theory, you could play a 3D chess with group permissions and page restrictions... for regular users.

However, "Confluence guests get full access if added to a group that grants product access."

A page is a page is a page, so what you want to achieve seems impossible. 

However, there are workflow apps (Workflows for Confluence by Appfox, Breeze by B1nary, Appfire has several under the Comala moniker...) that do offer a more granular level of control.

But I don't know if they can work with guests the same way they can work with users.
