Keep server.xml with Confluence Installer or stop autostart

Is there a way to keep the configured server.xml in confluence after an upgrade or to stop the autostart?

background:
after upgrading confluence with the installer, it always resets the context path and that corrupts the confluence index...
we already spent an hour figuring out what the problem was...

is there maybe some kind of systemvariable i dont know of to pass the context path to the installer?
