We are wanting to use the documentation theme but cannot choose the option when creating the space? See screenshot provided below.
We change the theme in the admin panel and select the checkbox to see the treelist but nothing happens.

Have you tried create a space again after the configuration? Is the issue still persist? Also, I suspect that you changed the theme from Global Level which is Browse >> Confluence Admin instead of from Space Level which isBrowse >> Space Admin. Could you please double confirm on that?

You're right in saying that we no longer get the option to add the documentation theme when creating the space. The "Add Space" screen has been simplified in the latest versions of Confluence. (See the Confluence 4.2.6 release notes: https://confluence.atlassian.com/display/DOC/Confluence+4.2.6+Release+Notes.) That explains the screenshot in your post.
But you should still be able to select the Documentation theme in the space admin section. (Go to a page in the space, and choose Browse > Space Admin > Themes. Then choose the Documentation theme. The "Page Tree" checkbox is selected by default for the theme.)
From what you write, it sounds as if you've selected the theme. The space should then show the left-hand panel and the Documentation theme styling. If it doesn't, perhaps there's some site-level configuration or CSS that's overriding the theme.

Yes we did apply the theme and no it does not show the left hand panel. This was installed fresh with no CSS. What configuration could stop it from showing?
