choosing a title wich already exists for a new page overwrites the existing page

This question is in reference to Atlassian Documentation: Create from Template Macro

if we make a new page by clicking the macro and the page title we choose exists already in that space we expect that the page will not be saved and an error message is displayed. this does not happen, instead the existing page is overwritten. is this a bug? we use confluence 5.10.1

We also just ran into this issue on 5.10.6, exactly as you described. We just upgraded from 5.4.9, which did not have this issue.
