The location of the navigation pane is static, you cannot move it to the top. However, Atlassian is working improvements to it, you can read more about them here.
There is also a link in there to a Chrome Extension you can add to test it out.

As Scott well mentioned, the navigation pane is static. Also, there will be a release (very soon to come) of an improvement to the Jira navigation system as a whole, which will include the topBar navigation system. Please bear in mind, the extension is a prototype override that will not let you harness some of the performance optimizations the navigation team is rolling out.
