We currently have JIRA Software Server. We have no need for the very expensive JIRA Datacenter. We also have our own AWS EC2 instances and we are migrating several of our on prem applications to our AWS EC2 instances.
Do we need to use the cloud migration tool to host our JIRA Software intance on our AWS EC2 instance?
Could we purchase JIRA Software Cloud licensing and host on our own AWS instances vs purchasing DataCenter?

Your AWS install would be a Data Centre code.
Jira Cloud is "software as a service", not a server install you can run yourself.
So far, Trello is the only Atlassian Cloud product certified as fedramp'd

So if we were to run our JIRA Software application on our own AWS instance, would we need to purchase Data Center licensing?
Currently we have server licensing. I know in Feb 2024 sever licensing will no longer be offered but in the mean time, should we just install JIRA Software Server app on our EC2 instance and before Feb 2024 do we just purchase DC self hosted license?

Yes, because your server licence will be invalid on the new hardware, and you can't get a new one.

Welcome to the Atlassian community.
Please note that currently, you cannot use the migration tool to migrate data from your on-prem to AWS EC2 instance. As it is designed to help customers migrate from on-prem to Atlassian cloud only.
Please note that self-hosted/maintained AWS EC2 is still a virtual data center setup, in this case, you will have to deploy the Jira app as a data center on an AWS instance and then perform a Datacenter to datacenter migration.
On the other hand, if you want to migrate the data from your on-prem to Atlassian hosted Cloud environment, the below resources should guide you.

That answers my migration question. But the critical question is below.
Could we purchase JIRA Software Cloud licensing and host on our own AWS cloud instance.? We only have 100 seat license for server now and we will not need, nor will management approve purchasing an expensive DataCenter license.
We would not be able to migrate to Atlassian Cloud unless JIRA becomes FedRamped.
