I am trying to create a filter that contains all issues that have subtasks.  Can anyone assist?

You will need to use a plugin such as scriptrunner to accomplish this.  This provides a function that allows you to search has subtasks.  There are also other apps in the marketplace that provide this functionality.

there isn't a native JQL function for this. There are a number of addons that will allow you to do so however - check the Marketplace
