I have emailed the admin to find out if emails have been switched off in the dev environment as this is the only issue I can think of , that could be causing this

If this rule is initiated by another rule firing (meaning another rule causes the issue to transition) then you have to check the box in the Rule Details for Allow rule trigger.

So does the rule not fire? Or it fires and it doesn't process complete to send the email? Or it fires, says it sent the email, but the person never got it?
Can you post a screenshot of the Audit Log when it runs?
