We are in the process of updating our Help desk and this will result in issues failing to create and I would like to create an automation that will send an auto-response when a ticket fails to create.

This does sound like something Jira automation rules could handle for you. Can you give us some more information about your service desk updates please?
Do you mean changes to your existing Jira Service Desk project configurations? If you're on cloud this would not be software updates. Why would issues fail to create?
